Peter M asked:

This is what i have read up on…but other answers lead me to believe that i have made an fair exchange with apple: i gave them 200 dollars and they gave me an 8 gb ipod touch. i can now do what ever i want with it now.

Jailbreaking an iPhone constitutes copyright infringement and a DMCA violation, says Apple in comments filed with the Copyright Office as part of the 2009 DMCA triennial rulemaking. This marks the first formal public statement by Apple about its legal stance on iPhone jailbreaking.

Apple’s iPhone, now the best-selling cellular phone in the U.S., has been designed with restrictions that prevent owners from running applications obtained from sources other than Apple’s own iTunes App Store. “Jailbreaking” is the term used for removing these restrictions, thereby liberating your phone from Apple’s software “jail.” Estimates put the number of iPhone owners who have jailbroken their phones in the hundreds of thousands.

As part of the 2009 DMCA rulemaking, EFF has asked the Copyright Office to recognize an exemption to the DMCA to permit jailbreaking in order to allow iPhone owners to use their phones with applications that are not available from Apple’s store (e.g., turn-by-turn directions, using the iPhone camera for video, laptop tethering).

Apple’s copyright infringement claim starts with the observation that jailbroken iPhones depend on modified versions of Apple’s bootloader and operating system software. True enough — we said as much in our technical white paper describing the jailbreak process. But the courts have long recognized that copying software while reverse engineering is a fair use when done for purposes of fostering interoperability with independently created software, a body of law that Apple conveniently fails to mention.

As for the DMCA violation, Apple casts its lot with the likes of laser printer makers and garage door opener companies who argue that the DMCA entitles them to block interoperability with anything that hasn’t been approved in advance. Apple justifies this by claiming that opening the iPhone to independently created applications will compromise safety, security, reliability, and swing the doors wide for those who want to run pirated software.

If this sounds like FUD, that’s because it is. One need only transpose Apple’s arguments to the world of automobiles to recognize their absurdity. Sure, GM might tell us that, for our own safety, all servicing should be done by an authorized GM dealer using only genuine GM parts. Toyota might say that swapping your engine could reduce the reliability of your car. And Mazda could say that those who throw a supercharger on their Miatas frequently exceed the legal speed limit.

But we’d never accept this corporate paternalism as a justification for welding every car hood shut and imposing legal liability on car buffs tinkering in their garages. After all, the culture of tinkering (or hacking, if you prefer) is an important part of our innovation economy.

Of course, many iPhone owners will be happy to choose solely from the applications that Apple is willing to approve, just like many Ford owners are happy relying exclusively on their local Ford dealer. But if you want to pop the hood, the DMCA surely shouldn’t stand in your way.

SouthBay asked:

Here is the answer:

The toner & Ink at Rhinotek is ISO 9001 Certified which means that they are GUARANTEED to meet or exceed to specs of any OEM.
Additionally, using non OEM WILL NOT and CANNOT void a warranty.
This is why:

The Sherman Clayton Act

It is illegal to require or force the owner of a computer printer to use only the
OEM’s brand supplies. To make this requirement is in violation of the Sherman
and Clayton Antitrust Act.

A classic example
of this issue was brought before the U.S. Supreme Court in 1956, involving IBM vs. the United States. At the time, IBM leased data processing machines to customers with the
requirement that they use only the tabulating cards manufactured by IBM. Their
customers were threatened with termination of their lease if they used cards produced by other manufacturers. As decided by the U.S. Supreme Court, this requirement in IBM’s lease agreement was held to constitute a “tying agreement”, and was found to be in
violation of the antitrust laws.

Don’t be intimidated
by sales or service people. Let them know that a computer printer manufacturer cannot legally require, in writing or verbally, that a printer owner or lessee exclusively purchase ribbons, toner or any other type of supply from them. In order to make this kind of
requirement, they must conclusively demonstrate and prove that other brands of supplies are incompatible to their printers, and they must state this

Matienzo asked:

We just purchased a new ERP system and on of the things we can do is print checks using a laser printer on a special paper for checks.

I was told that we need to use a special toner to print the checks, called MICR toner or magnetik toner so that the machines at the banks can read it when they process it through their scanner.

I checked at a website www.checksnet.com and talked to someone there and they told me of course, they were the best, etc., etc. Their website doesn’t give me the impression that they are the best…and they won’t send me a printout as a sample so I can check with our bank if they are OK with it. Checknet.com offers a toner cartdrige for $236.51 and they claim a yield of 18,000 checks!!!!

I also checked with our copier-vendor (IKON) and they offer the MICR toner for $167.00 and they say the yield is 6,000 pages.

I have no idea if that makes sense. I’m aware they base the estimates on a 5% printed surface. Price difference between vendors is too big

Bobby K asked:

I have an Apple Color LaserWriter 12/660 printer that has been in storage for 5 years while I searched for a fuser oil bottle. I found one, but now the cyan toner cartridge isn’t working. When I open each cartridge up, there is a metal transfer roller to bring out the toner and on the other colors, it is neatly coated with toner. However, on the cyan cartridge, I see only bare metal. I tried shaking the cartridge a whole lot, and I tried vibrating the cartridge to loosen it up thinking there might be some compacted toner blocking the feed path. The printer and all of it’s supplies only have 41 pages on them, so I know it has plenty of toner.

Has anybody had this problem before, and how did you fix it?
